1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Dokreativ Technologies OPC Private Limited ("Company", "we", "our", or "us") concerning your access to and use of the Mailari email verification service (www.mailari.io) and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must meet the following requirements to use the Service:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information
• Maintain the security of your account credentials

3. Service Description

Mailari provides email verification services that check:

• Email address syntax and format validation
• Domain and MX record verification
• SMTP mailbox existence checks
• Disposable and temporary email detection
• Role-based account identification
• Catch-all domain detection

The Service is provided on a credit-based system. Each email verification typically consumes one credit.

4. User Accounts

4.1 Account Creation

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

4.3 API Keys

API keys generated through your account are confidential. You must not share your API keys publicly or with unauthorized parties. You are responsible for all usage of your API keys.

5. Credits and Payments

5.1 Credit System

• Credits are consumed for each email verification performed
• Credits are non-refundable once purchased (subject to our Refund Policy)
• Credits do not expire
• New users receive 30 free welcome credits upon email verification

5.2 Pricing

Current pricing is displayed on our website. We reserve the right to modify pricing with 30 days' notice to existing customers. Price changes do not affect credits already purchased.

5.3 Payment Processing

Payments are processed through Razorpay. By making a payment, you agree to Razorpay's terms and conditions. All prices are in Indian Rupees (INR) unless otherwise stated.

5.4 Taxes

Prices exclude applicable taxes (GST, VAT, etc.). You are responsible for all taxes associated with your purchase.

6. Acceptable Use

6.1 Permitted Use

You may use the Service to:

• Verify email addresses you have lawfully collected
• Maintain email list hygiene for marketing purposes
• Prevent fraudulent signups and account creation
• Improve email deliverability for legitimate business purposes

6.2 Prohibited Use

You must NOT:

• Use the Service for illegal purposes or to violate any laws
• Verify email addresses obtained through scraping, harvesting, or unauthorized means
• Send spam or unsolicited commercial emails to verified addresses
• Attempt to reverse engineer, decompile, or extract source code
• Resell, redistribute, or sublicense the Service without authorization
• Use the Service to harass, abuse, or harm others
• Circumvent rate limits, security measures, or access controls
• Upload malware, viruses, or malicious code
• Interfere with or disrupt the Service or servers
• Create multiple accounts to abuse free credits

7. Service Availability and Performance

7.1 Uptime

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance with or without notice.

7.2 Accuracy

While we aim for 99.5% accuracy, email verification results are provided on an "as is" basis. We do not guarantee 100% accuracy due to factors beyond our control (mail server configurations, temporary issues, etc.).

7.3 Rate Limits

We implement reasonable rate limits to ensure fair usage. Excessive API usage may result in temporary throttling or account suspension.

8. Intellectual Property

8.1 Our IP

The Service, including all software, algorithms, APIs, documentation, logos, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws.

8.2 Your Data

You retain ownership of email addresses and data you submit for verification. You grant us a license to process this data solely to provide the Service.

8.3 Feedback

Any feedback, suggestions, or ideas you provide become our property, and we may use them without obligation or compensation to you.

9. Data Processing and Privacy

Our collection, use, and protection of your personal data is governed by our Privacy Policy. By using the Service, you consent to such processing in accordance with the Privacy Policy.

For GDPR purposes, you are the data controller and we are the data processor for email addresses you submit for verification.

10. Disclaimers and Limitation of Liability

10.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR ₹10,000, WHICHEVER IS LESS.

11. Indemnification

You agree to indemnify, defend, and hold harmless Dokreativ Technologies OPC Private Limited, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of third parties
• Your violation of applicable laws or regulations

12. Term and Termination

12.1 Term

These Terms remain in effect while you use the Service.

12.2 Termination by You

You may terminate your account at any time through your account settings. Unused credits are non-refundable upon termination (subject to our Refund Policy).

12.3 Termination by Us

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion.

12.4 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership, disclaimers, indemnification, and limitations of liability.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a prominent notice on the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka, India.

14.3 Arbitration

Before filing a lawsuit, you agree to first attempt to resolve disputes through good-faith negotiations. If negotiations fail, disputes may be submitted to binding arbitration in accordance with Indian arbitration laws.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including acts of God, war, terrorism, natural disasters, or internet service provider failures.
